Rep. Tom Cole, R-Okla., a member of the Chickasaw Nation and only Native American currently serving in Congress, has introduced legislation aimed at fixing the Carcieri v. Salazar Supreme Court ruling from February.
A fix has already been introduced in the Senate. Few Republicans have expressed support in both the House and Senate.
Cole’s bill, H.R.3697, says that all tribes, regardless of their date of federal recognition, can follow the land into trust process, which has long been overseen by the Interior Department.
“This bill will clarify federal law to ensure all federally recognized Indian tribes are able to participate in the trust process with the United States,” Cole said.
“There has been too much confusion with the way the law is currently written. The trust process was meant to allow tribes to purchase lands for their benefit.”
The Supreme Court decision found that tribes not under federal jurisdiction in 1934 could not take land into trust as can tribes recognized before that year. Many tribal leaders have found the ruling to be flawed.
