Arizona law draws widespread indigenous opposition

PHOENIX – A controversial new state anti-immigration law has many American Indians alarmed that tribal sovereignty has been violated, with the looming possibility that individual liberties will be threatened.

The law, S.B. 1070, makes it a crime to be in Arizona illegally, and it requires police to check suspects for residency paperwork. It also bans people from soliciting work or hiring day laborers off the street.

The state’s legislature passed the bill in late-April, with Republican Gov. Jan Brewer signing it into law shortly thereafter.

Republican supporters have argued that the measure is necessary to protect the nation’s borders by reducing illegal immigrants and the burden they place on taxpayers. Some believe that drug cartels and crime will also be combated.

Those ideas have been widely controversial, with many progressive groups, Hispanics, and the Obama administration protesting the law. The main questions center on what factors police will use to decide if a person should be required to show paperwork.

Racial profiling is a top concern, and lawsuits to challenge the law’s legality are certain.

As the debate has progressed, Native American perspectives have also quickly become part of the mix. Many observers have noted that it was the indigenous people of North America who welcomed European immigrants to the continent hundreds of years ago.

The Inter Tribal Council of Arizona has been one of those leading the charge, sending a letter that urged the legislature and governor not to pass the law.

“We have a range of concerns, including tribal sovereign nations not being recognized as able to define and protect their own borders as they see fit, and the possibility that tribal citizens will be profiled by police,” said John Lewis, director of the organization.

Lewis and other ITCA staffers traveled to Washington after the law passed to educate national policy makers about their concerns. Various Native American groups are calling on tribes and Indians to oppose the measure, hopefully to get it repealed.

“This impacts all indigenous people, and the lawmakers need to know it,” Lewis said. “America’s boundaries are not tribal boundaries.”

Lewis noted that some tribes, including the Tohono O’odham Nation and the Pascua Yaqui Tribe, are on and near the U.S.-Mexico border.

“Our tribes have much interaction with Mexico, through culture and life, and I’m not sure people realize that there’s an economic impact involved as well.”

Lewis and others believe that American Indians are likely to be unfairly targeted, based on their appearance and travel patterns. The American Civil Liberties Union has expressed similar concerns, and has vowed to monitor that aspect of the law.

“Even if they are just stopped for five minutes, that is five minutes too many if the rights of people have been infringed,” Lewis said.

Ian Record, an education manager with the Native Nations Institute, said he is concerned that he could be targeted, since his truck has a “Latinos for Obama” sticker on it.

“It’s scary that something like that could be a factor in you getting pulled over. My wife is Latina. We shouldn’t be afraid of that.”‘

Record noted that citizens of the Tohono O’odham Nation and the Pascua Yaqui Tribe have been strongly rallying against the law.

“It complicates things for tribal citizens, especially of those nations. It has to be greatly concerning to everyone that law-abiding citizens of those nations are likely to be pulled over,” Record said.

“The tribe’s sovereignty and the tribal citizens’ rights are obviously being harmed.”

Robert Warrior, the Osage president of the Native American and Indigenous Studies Association, echoed those issues in a letter to the governor April 24.

“Your action as chief executive of the state of Arizona will, when the law takes effect, give license to abuse by police and citizens, making ever more murky the possibility of working towards a just future for all people in the Americas,” wrote Warrior, director of American Indian Studies at the University of Illinois at Urbana-Champaign.

“S.B. 1070 will have tremendous negative impact on indigenous people on both sides of the border between the United States and Mexico, and it ought to go without saying that some of the people most impacted by this invidious law are descended from peoples who lived in the Sonoran Desert centuries before anyone even thought of the United States. Regardless of proximity or descent, though, the new law is morally wrong and panders to the worst currents in U.S. politics.”

Warrior said in an interview that the regulation seems to be “myopic by design,” since it seeks to take complex realities and make them seem simple.

“Given that many thousands of indigenous people are from communities that have straddled the U.S.-Mexico border since long before that border came to be, I see this law as a tragic reminder of how polluted political culture in the U.S. has become.”

Warrior said tribal citizens throughout North America should see the situation “as a call to think about where we are headed as indigenous peoples whose right to exist predates the borders that now so often keep us apart.”

“We need a growing consciousness of what our persistence and presence means in the hemisphere. For those of us who are U.S. citizens, a law like this provides an opportunity to oppose the worst currents of U.S. political life and to stand in solidarity with those whose human rights are violated in the name of security.”

SB-1070 is way overdue. The American people dserve a Federal Govt. that is interested in protecting its borders. If past and present Republican and Democrat Federal administrations took action Arizona would not have to legislate. I am truly saddened by the racist response from natives against those they define as "illegal". Heck, it was legal in the early statehood of CA to have Indian child slaves and the Supreme Court held CA natives to be trespassers on the public domain or in other words illegal occupants of their aboriginal territory. Have native people railing against illegal aliens in these comments forgotten the racist laws they faced. Also, very few Mexicans are "Spanish" we are nearly all mestizo or mixed Indian and Spanish many of us have more Indian blood than enrolled members of Tribe in the U.S. I really would expect more empathy than that reflected in these comments.

Maybe I read different books, and as an artist see the world more inclusive; I am struck by ATZLAN, and what I see of migration patterns and in the arts of the Ancient Puebloans I don't think they were 'Indians or Mexicans'. I am surprised/shocked by how separate/alienated people have become. Time to peel back history and imagine where we all came from and what has influenced our viewpoints. They loved native culture, took language classes, dressed up real fancy in indian costumes, learned tribal dances and songs, even got hold of ealgle feathers and pipes, made offerings at sacred sites just like Native People. Ok imagine this O'odham grandmother, and this really happened out here, not just a hypothetical, was stopped driving her truck out on the dirtroad from her house going out to the pavement road a halfmile from her house. A large branch of a mesquite tree was pulled into the road where it crossed the wash. She got out and 20 illegals rushed her from behind the trees and beat her. they had big sticks of that hard mesquite and beat her, her arm and fingers were broken, they stole her truck and left her there, broken and bleeding. It was a while longer when another O'odham traveled down the road and saw her and called the police and ambulance. None of the illegals/mexicans were ever caught. This is the situation out here everyday for our elders and those who cannot defend themselves. When those illegal get to Pheonix, do you really think they deserve to be protected?? The biggest problem is that no one understands what it is like to walk in another person's shoes. Here for example why this law is not well thought out. If a person crosses the border illegally carrying a baby, and lives in the US for 20 years illegally. That baby grows up in a society but is not a legal citizen, with this law, that person can be deported or detained simply because they are not a citizen because the process for citizenship requires one to enter the country legally, that person is now a criminal not of their own doing, but their parent who brought them over here illegally is the criminal. If a grandmother only spoke Dine', then she's not going to be arrested because the border patrol isn't going to understand her either, so they'll know she isn't speaking spanish. A check of the license plate would show the truck is from the reservation so that would be the first clue to anyone. Another thing is there really aren't any Natives who don't at least understand a few phrases in English. Maybe 30 or 40 years ago you might have someone who didn't understand but anyone born after 1910 would be exposed to English through technology and their children and grandchildren. They could easily say - I am from Shiprock.

Read the law it's the same as the Federal Law only it gives the State the same rights to act. My relations, This law is a threat to all. Imagine your grandmother traveling to phoenix and she forgets her wallet and her ID. She gets pulled over, suspected of being illegal only on the basis of her skin color. She does not speak English for she only knows her native tongue, Dine. All she wants to do is visit her children and grandchildren in Phoenix but she is arrested for not having documentation. Is this justice? Should we really support a law that would subject our family members to this injustice? I'm not Red, Brown or Black, and the last person who called me a Red Man was left sitting on the ground. I'm a full blood American N'dee, and First Generation U.S. Citizen who's parents, and all of theirs before them came from right here. I;ve seen wannabes, fakes and plastic play Indians come and go, and these are just another group trying to use us for their own ends. Come down and live a while on our reservations, and see how they are destroyed by the illegals. How the Government turns it's head, and makes believe everything is nice. At least till the wind blows, and their jobs are at stake. The illegals need to go, and the fools need to be voted out of office.

Most reservations have no jobs, so the male population gets in trouble, not always their fault; non payment of child support is a typical one, can't even get a driver license (what they gonna do???) This opens up new doors for new kinds of problems with Indian people; and for those Indians who think they are upstanding and no problem; try being in a state where there is a clear dual system of justice and clear record of racism, and police misconduct. If this is about locking down the border, rather than checking papers on the streets; SB1070 should be about sending the AZ National Guard to run sentry duty along the border and make it tighter than Guatanamo Bay and pretend the Mexican are Cubans.

ILLEGAL is ILLEGAL. My wife is from France. She had to wait months to get a "green card" then go through interviews with INS. She is a Resident Alien till she becomes a citizen. That is the process. That is the law and she abides by it. There are thousands of people in this country who disregard our immigration laws and have caused accidents even deaths, not all of them but some have. I grew up in Phoenix and know the Hispanic community there. They are also upset with illegals coming into their communities and causing mayhem, not all of them but some have done this. The loudest protests about this new law are coming from people who don't live in Arizona or even the border states where illegal immigration is problematic. If someone is stopped for an offense THEN the police may request identification if they suspect otherwise. Police aren't going to be trolling the streets asking everyone for identification! Stop the misinformation. Shame on anyone who knowingly breaks our laws.

I'm native but look Mexican & have dealt with being mistaken for Mexican/Spanish all of my life! I've gone thru "random" check lines & I always seem to be the one random card everytime! I know it's my looks & while I don't like it, I know that it is for my own safety. I don't think that racial profiling is going away anytime soon in light of the world circumstances that we now live in. But that does not make it right for those of us that look a certain way. I've often been more accepted by Mexican and Spanish people more so than by my own people, and in my own country too. I'm a nonfederally recognized Indian. And,to be non-federally recognized is to be treated like a non-native by not only other American Indians, but the government as well. Take for instance the current consultation meetings being held by the White House and federal agencies with federally recognized Indian tribes only. Let's face it - it all hurts!

I support the law, only because I live here out on the border and have to deal EVERY day with illegals and the problems they bring. Just yesterday morning I saw a mehicana sitting under a tree by the road(way out on the backroads). I stopped and talked to her, she wanted to be picked up by the BP's. I gave her my beansingle, and told her to stay there. As soon as I got back in cell range I call the TOPD to contact the BPs with the location. In the evening I passed tru and stopped to read the tracks, BP made it and she was picked up. Yep, sucks. She should have just gone down to the US immigration office and applied LEGALLY for a visa of some sort, rather than attempting to kill herself out in the desert. I think they should just follow the law like anyone else. I have to do the same when i travel in mexico, which has much tougher laws than here. Any mexican could tell you that. They get away with too much already. Support the Law.

We should focus on LEGALITY, because that is the whole POINT of this law. Natives in Arizona, my homelands, have every RIGHT to be here. I will not be deported nor will my relatives or my children. An illegal person, regardless of "color", if they break the law (drugdealing, smuggling, childmolesting, murdering, theivery, etc.etc) will eventually be found out and besides criminal charges, eventually face deportation. Everyone knows it. The latent function of this Bill is to weed out Mexican's. If you look at the White Mountain Independent newspaper online there are some very racist remarks. I am not worried about myself getting deported because I am citizen of the USA and an enrolled member of an Arizona tribe. But my appearance looks Hispanic/Mexican in Tucson and Phoenix people always talk to me in Spanish. My sister was on a bus near the Texas, New Mexico border when it was stopped and all the passengers were ordered off by the Border Patrol. As they were exiting based on their appearance the Border Patrol were separating Mexican looking people from white people. My sister did not even know what was happening, she was not asked for any ID, nothing. Then the group of Mexicans she was placed with were told to board this green and white bus. ONLY AFTER she asked one of the officers what was going on, did he ask her for ID and where she was from, her American Accent gave her away.

Why are we Natives involving ourselves in the issue between AZ & Mexicans? Yes, the ID issue is going to spread to other states and inconvenience Native people. But, if your an enrolled Native with ID, which we'll have if we are truly Natives, we'll be okay. Legal Mexicans in our City feel that all the immigrants should enter the US in the legal way that they had to. When we have people sneaking over the borders, we get the non -desirables, criminals, ID thiefs, etc. Perhaps, Arizona has started the beginning of controlling illegals, an issue that should have been dealt with a long time ago by the Govt. As Natives we have our own struggles to deal with, without worrying about people who don't want to obey the laws, for whatever reasons. Yes, feeding family in Mexico is an important issue, but there is no justification for being lawless. Illegals should become legal with no amnesty! Let them earn the right to be US citizens like others have to do. Let's get real and not radical!

Only when I apply for a job do I have "to prove" that I can work in the US, any other time I just have to prove who I am and all you Indians who support this law feel it's okay to have to prove you're not only an Indian, but that your a citizen of this country? There's only certain times I have to prove my citizenship, walking down the street and possibly being a victim of a crime doesn't constitute that I have to prove I'm a citizen. When the Harvard Professor was arrested in the middle of the night because a neighbor saw him break into his own house cause he lost his key... Then, Obama invited him to the White House to have a beer with the policeman that arrested him and threw him in jail. This is the same situation, the professor was arrested cause of the color of his skin and it was racial profiling by the neighbor. Obama stood up for his brother, invited them all over to make nice and now with this bill they can go after Native Americans and Hispanic/Americans and Mexican/Americans just for their skintone. It is unconstitutional, illegal, immoral, and totally, un-American!!!

I dont know if you ever listen to the news or read the papers, but back in September 2001 everyone has had to show their Papers a.k.a. identification (drivers license, passport) to prove that we are U.S. citizens and not illegal. In reading up to page 4, I have yet to come across that anyone who "simply looks spanish is to arrested without probably cause". It might be on page 8, but I wont know till I read that part. This is a free society as long as you obey the laws that are in place to protect U.S. citizens. Just like having a drivers license is mandatory to operate a vehicle, you need your identity to carry out your life in this country. If you feel that Mexico or the South America continent is freer, there is a group of people calling themselves indigenous and they have no qualms about you being free to wander all over the place down there.

As indigenous people we roamed the open land and defended our territories to keep our people from harm. In 2010 we need to keep this in mind especially with terrorism on the rise. Native people are suffering from drug addictions in which a majority of drugs are from Mexico which leads to other social and economic problems on the reservations. I have gone to other countries and I was always asked for identification. The Immigration law is a plus for native country.

Here's the problem: This law makes it ILLEGAL to leave your home without "papers" and this applies to everyone (brown, white, purple) across the board. It also allows for anyone who simply "looks" Spanish to be arrested WITHOUT probable cause. How about not trampling upon my rights and the constitution? How could anyone who favors a free society support this law?? As a Native American who "looks" Spanish I would rather not be arrested while walking to work because I forgot my passport.

The law is clear and being former Tribal Police I know your treated worse by your own then anyone else. AZ law is a good one and is written in plain language. What everyone is saying is that we can trust our Police to give their life for your safety and protection but we can't trust them to do their job and obey the law themselves. Yes their will be a few that will screw up but they will get caught and will pay for their screw up. This isn't about profiling because profiling is a big part of Police work. If Police didn't profile every day they would never prevent crimes that are preventable from happening. Thank you for reading this and read the law and trust your Police before making assumptions. In 2006 I moved into a apartment complex. There where no Hispanics. 2 months later a apartment became vacant. A 2 bedroom apartment. a week later 9 non english speaking people moved into that apt...along with 3 junk vehicles. A year later my girlfrined and I were the only english speaking people there. My girlfriend was almost raped twice, I was attacked with a hammer and had my arm broke. All the while the Portland OR city police did nothing. I was ready to kill. I had to move. People need to move away from the issue of "race" and look at the problem in detail. Illegal immigrants are breaking the law. According to the US Dept of Justicese several drug gangs from Mexico send their dealers to Indian reservations so they blend in easier. They are told to find a girl to shack up with and begin to distribute their wares. Often times they sell marijuana and meth within the communities. Such activity has been documented as far north as in Lakota territory and within numerous communities on the Navajo Nation. Such a law like this is meant to stop what the feds haven't done much about except write. Thank goodness for SB 1070 and for Senator Pearce trying to protect what the federal governemtn has failed.

My study has led me to be cautious while witnessing Americans manipulate reality. In the first days of contact with the distorted intentions of invaders from Europe, the human act of being courteous to strangers should not constantly be spoken of as "The natives welcomed" those callous brutes because the word "welcome" continues thhrough American and European history in a distorted translation that emerged from the palsied reasoning of the invasion mentality, that the indigenous "gave" this land to the invading forces. This earth did not belong to anyone to give away, and it still dosen't. When the European says "X belongs to me," that means absolute owership and control. That reasoning is not prepared to accept that earth is a gift from many higher powers to the autochthonous beings to care for, respect, love and enjoy.
