Utes file lawsuit against John Jurrius

WASHINGTON – The Ute Indian Tribe of the Uintah and Ouray Reservation of Northern Utah has announced a lawsuit against John Jurrius and business entities affiliated with him.

According to a release authorized by the Cesspooch administration, the lawsuit, filed in federal court in Colorado, levels four specific allegations against Jurrius and his affiliated companies:
  •  “Assuming, without investing its own capital, an equity position in the tribe’s investments and projects.”
  •  “Failure to properly notify the tribe of ... intention to exercise ... participation option.”
  •  A claim that Jurrius and his affiliate companies misrepresented themselves as licensed investment advisers; and that he
  •  Violated fiduciary duties of good faith and fair dealing.
Jurrius, who said he had not been served with papers in the case as of Sept. 16 and only learned about it from the press and through the Internet, called the lawsuit “politics at its worst.”

“I can’t emphasize enough that the people of the Northern Ute tribe are my friends,” said the former energy development specialist for the tribe, who held the official title of financial adviser. “I hate it that my name is linked with litigation, but court is the place for it. They don’t like what the previous council agreed to and they want to change it.”

Uintah and Ouray Ute Chairman Curtis Cesspooch said he isn’t worried about conveying a message of tribal political strife and dysfunction to potential investors. The message they should take away is that they must do business openly, for all the tribe to see, in a manner all of its citizens can understand. Jurrius insists the complex transactions that created the new Ute energy companies were conducted openly and are, in fact, on film.

Tom Fredericks, general counsel for the Ute with the firm of Fredericks Peebles & Morgan LLC, acknowledged political disputes on the reservation but denied that they motivate the lawsuit. “This had nothing to do with politics. This had to do with an audit of venture fund records.” His firm and the tribe took the audit results to a financial specialty firm, Milberg LLP in New York City, which advised proceeding with a lawsuit, he said.

At the core of the dispute is Jurrius’ share in the current and future profits of two tribal companies, Ute Energy Holdings LLC and Ute Energy LLC. Fredericks estimated the value of the two companies to be in the hundreds of millions of dollars, with great growth potential from there. Jurrius’ purported stake in the future profits of the companies is just under 15 percent, he said.

As part of a team effort, Jurrius had helped to create similar entities with the Southern Ute. Cesspooch emphasizes that this doesn’t mean Jurrius made the Southern Ute wealthy, something Jurrius has never disputed.

The financial performance of tribal energy companies Jurrius helped to create has led to his description in print as everything from a sheriff to a messiah, but Jurrius has consistently stated that his only goal is to make money – one dollar for every 10 that goes to the tribes.

Cesspooch said that since Jurrius ceased to work for the tribe, its energy revenues have been on the rise. He denied that the increase is due to astronomical rises in global energy prices since Jurrius left the tribe’s service. He gave “better dealings” as the reason, providing no detail.

The Cesspooch administration got into office on an anti-Jurrius platform, Jurrius said, adding that discrediting him is its game plan for staying in office in the February and May 2009 elections. Jurrius and his affiliate companies participated in profits under the previous administration, he said, always as called for by his contract with the tribe.

His contract also called for a monthly salary of up to $62,500 a month, Fredericks said. Neither Cesspooch nor Fredericks volunteered a comment on whether full payment to Jurrius of a $750,000 annual salary reflects services fully rendered.

I'm amazed that the article on Ute Tribe Sues former Financial Advisor John Jurrius. I would like to put this issue to rest. Ute Indian Tribe had to settle out of court with John because the Ute tribe BC did on have a leg to stand on, the tribal council of today's Tribal attorney Fredrickson just made a cool 2.5 Million for himself for settleing out of court, and still billing the tribe thousands of dollars. Now who is the Gold Diggers?

As far as Ft. Peck is concerned, it's a shame that current council members Rick Kirn, Tom Christian, and Chairman Stafne are in such a hurry to finalize this business deal especially with Jurris now being sued by the Utes. Kirn, Christian, and the chairman signed this deal in secret far away from the rez in Billings not wanting the tribal membership to have any access to the business meetings so tribal members could hear the details of the deal. Hell Tommy didn't even bother to read the deal.

Hey Ute brethern, Don't feel bad I hear Jurrius is now about to swindle the Fort Peck Sioux and Assiniboine. Today the Tribe signs a lucrative agreement (for some crooked council members anyway) in Billings. I guess Jurrius is in a hurry to sign the deal before the Tribes Attorneys and oil experts can punch any more holes in his business theory which calls for the Tribe in invest everything while he is off the hook as far as investing his own capital yet he controls everything!

In response to your comment the tribe supports John Jurrius 100% is a false statment! He was only supported by a certain group, even then only that group is the only one that benefited from his support. So where is the justice in that? I hope he is prosecuted to the fullest extent of the law. The current Business Committee has brought back honesty, fairness and integrity to the council and the tribe!

As native people- we need to recognize that our economic success does not make us beholden to those who we have paid to realize it. Just because people (attorneys, investment advisers, etc.) have been in the right place at the right time with the reasonably necessary skills does not mean they are our saviors, it means we should hold them to the same standards that other professionals are held to. They are instruments that sovereign nations use to achieve their goals of self determination.

"He" made them rich,billionaires, etc. What "He" did was to use the sovereign rights of the tribe in the way a reasonably skilled and economically educated professional should and this brought economic success. The tribe paid for these services and set up a contract for him to use what the tribe had all along, what has been carried on the backs of our ancestors for thousands of years. That is the right to be self determinate. He broke that contract according to the complaint and should account.

When they state that he assisted the tribe in establishing comprehensive banking relationship and in identifying investment opportunities, and authored their Financial Plan and forming the Growth Fund. I am very disgusted by the Cesspooch Administration,the law suit, false information. I was part of the Venture Board that created Ute Energy LLC, Ute Holdings LL. It was the people that passed the Financial Plan Authored by John Jurrius, the membership are the one's that approved John's contract, agreements, and Interest in all the venture of the Ute Indian Tribe because the Ute Tribe did not have One penny to pay him, and he has done an excellant job. I am a member of the Ute Indian Tribe. I have not see any new investments from the Cesspooch administration. The energy renvenue are coming from rising energy cost and the invetments, negocations John Jurrius had completed. He made the Southern Utes rich and I had hoped he would do the same for us. If, this law firm have done more homework they wouldn't have filed this futal lawsuit. I would like to see this Business Committee resign their seats when John wins this lawsuit.
